As a trustee of a Self-Managed Super Fund (SMSF), it’s crucial to understand the importance of accurately recording your fund’s assets at market value each year. The Australian Taxation Office (ATO) has heightened its scrutiny in this area, leading to increased vigilance by Fund Auditors. By ensuring that you are well-informed about the valuation requirements of your SMSF’s investments, you can simplify the audit process and maintain compliance.
Why Are Accurate Valuations Important?
Accurate valuation of SMSF assets at year-end is vital for several reasons, including:
- Pension Calculations: The value of SMSF assets plays a role in calculating pension commencements for Transfer Balance Cap purposes, contribution limits, and minimum pension payments.
- Tax Implications: For members with super balances nearing or exceeding $3 million, the proposed introduction of Div296 tax in 2025/26 will be impacted by asset valuations.
- Contribution Eligibility: Accurate valuations are essential to determine eligibility for making catch-up concessional contributions.
- In-House Asset Limits: The calculation of the 5% maximum threshold for in-house assets is based on the fund’s net assets.
- Avoiding Penalties: The ATO may impose penalties or additional taxes if SMSF assets do not meet valuation requirements.
Real Estate Property
Properties in an SMSF must be recorded at market value every financial year. However, this doesn’t necessarily require a formal external valuation each year. The valuation can be based on objective and supportable data. Acceptable sources for valuations include:
- An independent, formal valuation.
- A real estate valuation that includes comparable sales or other evidence supporting the valuation.
- Trustee assessments, including comparable properties and commentary on how the valuation was determined (e.g., net analytical yields on commercial properties).
The purchase price if the property was acquired close to 30 June.
Valuations should be performed close to 30 June of the relevant financial year.
Unlisted Companies and Unit Trusts
The Fund’s Auditor must ensure that any unlisted entities are recorded at market value. Audit evidence typically includes:
- The entity’s financial statements.
- Valuations of the underlying assets, such as an independent property valuation.
- Evidence of third-party share trades closest to 30 June.
Collectables and Personal Use Assets
This category includes items like artworks, jewellery, coins, wine or spirits, and motor vehicles. While a qualified independent valuation isn’t specifically required each year, it may be challenging to establish a proper basis for valuation without one due to the unique nature of these assets.
Cryptocurrency
For cryptocurrency, if a year-end report is available from your provider, the market value of crypto assets held at 30 June is generally recorded. Alternatively, the ATO suggests using the 30 June closing price from a crypto exchange website offering historical data.
Loans to Unrelated Parties
If your SMSF provides a loan to an unrelated party as an investment, the loan’s recoverability and value must be considered. Supporting documentation might include:
- A loan agreement.
- Evidence of full repayment of the loan following 30 June in line with the agreement terms.
- Proof of the borrower’s financial position to confirm their ability to repay, such as financial statements (for non-individual borrowers).
An SMSF is prohibited from providing loans to members. Loans to non-member related parties are considered in-house assets and cannot exceed 5% of the Fund’s total assets.
Asset Acquisitions from Related Parties
SMSFs are generally prohibited from acquiring assets from related parties, except for listed securities and business real property. Acquisitions must be done at market value, typically determined by obtaining an independent third-party valuation for business real property. It’s important to note that while crypto assets have listed values online, they are not considered listed assets and are prohibited from being acquired from related parties.
